Data protection at a glance
General information
The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. For detailed information on data protection, please refer to our privacy policy set out below this text.
Data collection on this website
Who is responsible for the data collection on this website?
Data processing on this website is carried out by the website operator. Their contact details can be found in the section “Details of the controller” in this privacy policy.
How do we collect your data?
Your data is collected in part by you providing it to us. This may, for example, be data that you enter in a contact form.
Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of the page visit). This data is collected automatically as soon as you access this website.
What do we use your data for?
The data is collected solely to ensure the secure and error-free provision of the website. We do not analyse your user behaviour; we do not use any tracking or analytics services.
What rights do you have regarding your data?
You have the right, at any time, to obtain information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you may revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You may contact us at any time regarding this or any other questions on the subject of data protection.
Hosting
Operation on our own servers
This website is not operated by a web host: it runs on servers that Raits Dalus Rechtsanwälte GmbH operates itself and that are located within the European Union. Page content, fonts, images and scripts are served exclusively from there; opening the site establishes no connection to any third-party server.
Operating the site serves our interest in a secure, fast and data-efficient provision of our online services (Art. 6 Abs. 1 lit. f DSGVO), as well as the performance of pre-contractual measures and contracts with our prospective and existing clients (Art. 6 Abs. 1 lit. b DSGVO).
Content delivery networks (CDNs) and external font services are not used. For the delivery and storage of messages from the contact form we do rely on two providers whose data centres are located within the European Union: the operator of the data centre in which our own mail server runs, and Microsoft as the operator of our firm’s mailbox. Data processing agreements under Art. 28 DSGVO are in place with both. No further data is passed on to hosting providers.
General information and mandatory information
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data as confidential and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various items of personal data are collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
Please note that data transmission over the internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
Details of the controller
The controller responsible for data processing on this website is:
Raits Dalus Rechtsanwälte GmbH
Ignaz-Rieder-Kai 11C
5020 Salzburg
Phone: +43 662 26033
Email: office@rdr.legal
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, email addresses or similar).
Storage period
Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible grounds for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place once those grounds no longer apply.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You may revoke consent you have already given at any time. The lawfulness of any data processing carried out before the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 DSGVO)
IF THE DATA PROCESSING IS BASED ON ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 ABS. 1 DSGVO).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING PURPOSES; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 ABS. 2 DSGVO).
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged breach. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.
SSL/TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, deletion and rectification
Within the scope of the applicable statutory provisions, you have the right, at any time, to obtain free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to rectification or deletion of this data. You may contact us at any time regarding this or any other questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You may contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you may request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
- If you have lodged an objection pursuant to Art. 21 Abs. 1 DSGVO, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – with the exception of its storage – only be processed with your consent or for the assertion, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.
Data collection on this website
Cookies
Our websites use so-called “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.
This website uses exclusively technically necessary cookies. No third-party cookies, nor cookies for evaluating user behaviour or for advertising purposes, are set.
Specifically, we only store your selection in the cookie notice so that it does not appear again on subsequent visits. This storage takes place on the basis of Art. 6 Abs. 1 lit. f DSGVO; we have a legitimate interest in the technically error-free provision of our website.
You can set your browser so that you are informed about the setting of cookies and only allow cookies on a case-by-case basis, exclude the acceptance of cookies for certain cases or in general, and enable the automatic deletion of cookies when you close your browser. If you deactivate cookies, the functionality of this website may be limited.
Should third-party cookies or cookies for analysis purposes be used in future, we will inform you separately of this within this privacy policy and obtain your consent.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
The IP address is stored in truncated form so that it is not possible to draw conclusions about individual persons. This data is not combined with other data sources. We use the log files to create aggregated access statistics (e.g. number of page views); no evaluation of individual visitors takes place. For this purpose the log data is transferred to a separate system operated by the firm, where it is deleted automatically after 72 hours.
This data is collected on the basis of Art. 6 Abs. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation, secure operation and optimisation of its website – for this purpose, the server log files must be collected.
Contact form
If you send us enquiries via the contact form, the information you provide in the form, including the contact details you enter there, will be stored by us for the purpose of processing the enquiry and in case of any follow-up questions. Transmission takes place in encrypted form to our own mail server, which is operated in a data centre within the European Union; from there the message is delivered to our firm’s mailbox, which we run on Microsoft 365 with storage in the European Union. No delivery provider for newsletters or bulk email is used. We do not pass this data on without your consent.
This data is processed on the basis of Art. 6 Abs. 1 lit. b DSGVO, provided that your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6 Abs. 1 lit. f DSGVO).
Enquiries by email, telephone or fax
If you contact us by email, telephone or fax, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request.
6 Abs. 1 lit. f DSGVO) or on your consent (Art. 6 Abs. 1 lit. a DSGVO), provided this was requested.
The data you send to us via contact enquiries will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
Plugins and tools
This website does not integrate any external plugins, map services, fonts or analysis tools. The link to route planning offered on the contact page only leads to Google Maps once you click it; until then, no data is transmitted to Google. Google’s privacy policy applies to the processing carried out there.
